ORDER. Learned AGA is directed to accept notice for respondents No.1 to 4.

Learned counsel appearing for the petitioner, on instructions, submits that the petitioner–institution is presently having a sanctioned and working strength of 84 teaching staff members. However, under the impugned notice, respondent No.2/authority has called upon the petitioner to furnish and assign teaching staff to the extent of 140 members. It is contended that the direction issued under the impugned notice is wholly disproportionate and factually untenable, inasmuch as the petitioner does not employ staff beyond the existing strength of 84.

Elaborating further, learned counsel would submit that the names indicated in the impugned notice, insofar as they exceed the existing strength of 84 teachers, do not pertain to employees of the petitioner–institution. It is also brought to the notice of this Court that a portion of the teaching staff are presently on summer vacation and are not readily available to comply with the impugned directions.

On instructions, it is submitted that the petitioner shall, by the next date of hearing, place on record the complete list of teaching staff presently employed in the institution. It is further undertaken that the petitioner, in his capacity as the head of the institution/Principal, shall take immediate steps to communicate with all teaching staff who are on leave or vacation and issue necessary instructions calling upon them to return and report before respondent No.2/authority forthwith.

Recording the aforesaid submission and undertaking, this Court deems it appropriate to direct that respondent No.2/authority shall not take any coercive steps against the petitioner–institution, subject to the petitioner ensuring compliance with the aforesaid undertaking. The petitioner shall ensure that all teachers who are presently on vacation are duly intimated and shall report before respondent No.2/authority within a period of one (1) week from today.

The petitioner shall also furnish a complete and authenticated list of teaching staff of the institution to respondent No.2/authority within a period of one (1) week from today. Respondents shall not take coercive steps till next date of hearing subject to compliance of order passed by this court.
